A group of prominent intellectual property law professors has weighed in on the high-stakes AI copyright battle between several authors and Meta. In an amicus brief, the scholars argue that using copyrighted content as training data can be considered fair use under U.S. copyright law, if the goal is to create a new and 'transformative' tool. This suggests that fair use could potentially apply to Meta's training process, even if the underlying data was obtained without permission.
This case has a clear piracy angle, as Meta used BitTorrent to download archives of pirated books to use as training material. Notably, the authors argue that, in addition to copying pirated books from Anna’s Archive and Z-Library, in the same process Meta also uploaded pirated books to third parties.
This week, a group of IP Law Professors submitted a “friend of the court” or amicus brief, backing Meta’s fair use defense. The professors, including scholars from Harvard, Emory, Boston University, and Santa Clara University, have different views on the impact of AI but are united in their copyright stance.
The brief stresses that Meta’s alleged use of pirated books as training data can be considered fair use. The source of the training data is not determinative, as long as it’s used to create a new and transformative product, they argue.
“The case law, including binding circuit precedent, holds that internal copying, made in the course of creating new knowledge, is a transformative use that is heavily favored by fair use doctrine,” the professors write.
The professors’ argument is centered around the concept of “transformative use.” They note that using books outside their original ‘reading’ purpose to create an AI model, transforms the purpose of the use. This internal copying, they argue, falls into a category courts have consistently recognized as fair use, also known as “non-expressive use”.
The amicus brief cites several cases to back up their line of reasoning. This includes the Perfect 10 v. Amazon lawsuit, where the Ninth Circuit found that it was fair use when Google created thumbnails using images copied from unauthorized “pirate” sites, because the resulting image search tool was transformative.
The authors cited conflicting cases, but the professors note that cases where fair use was denied typically involved copyright infringement related to personal consumption, rather than use of content to create something new.
The brief distinguishes this case from those cited by the plaintiffs, which involved unauthorized copying for direct consumptive use (e.g., downloading for personal enjoyment). In contrast, Meta’s internal copies were allegedly not perceived by humans but used to build a new tool.
“Fair use, like copyright as a whole, ‘is not a privilege reserved for the well behaved’,” the brief notes. “Fair use doctrine should focus on the consequences of a ruling for knowledge and expression. Other considerations should be left for other legal regimes.”
Other countries, including Japan, have reportedly crafted exceptions in their law to allow tech companies to train LLMs on copyrighted material, without permission.
The U.S. has no such exceptions, but the professors urge the court to consider fair use. As the VCR and other innovations showed, copyright shouldn’t stand in the way of new tools and developing technologies.

In a world where it seemed the general consensus had shifted towards more environmental and ethical consumption, how have these two brands established a global network reaching 150 countries worldwide, and what is at stake if they continue to grow unchecked?

How Are They So Cheap?
- Labour: The general rule is if you are paying an unbelievably low price for a product, the person making it has been paid an unfair wage for their labour. Often this means involvement of forced, child or penal labour and workers are subjected to awful conditions and chemicals. US lawmakers have previously warned of an ‘extremely high risk’ that Temu and Shein were using forced labour – for Shein this would look like as part of their supply chain manufacturing and Temu for offering products on their e-commerce site.
- Materials: Another huge sacrifice Shein and Temu make in a bid to keep prices extremely low yet profits up is with the quality, in particular the materials they use. The low-quality materials used and assemblage of items with little attention to longevity means the products often deteriorate and/or break quickly. But this is good news for Shein and Temu! Throwaway culture is how these platforms thrive, as they rely on our constant need to consume.
- Mode of production: Both Shein and Temy rely on high levels of consumption, to drive high levels of production, with a streamlined mode of production. This requirement for overconsumption is evident in marketing efforts on both brands’ platforms. What Are the real costs?
- Carbon Emissions: It is no secret that the fast fashion industry is one of the biggest contributors to carbon emissions, responsible for approximately 10% of all global emissions every year. Global supply chains, manufacturing of textiles, assembling of garments and transportation all add up towards a brands carbon footprint. Shein and Temu, more than ever, prioritize and even encourage throwaway culture (buy, throwing away, buying again) for profit.
- Toxic Chemicals and Pollution: Dying and treating textiles in the fashion industry is a huge contributor to water pollution globally, especially when regulation is poor/poorly enforced by authorities. This affects the quality of water for people locally and also for aquatic life. Furthermore, a recent investigation carried out by authorities in South Korea found carcinogenic substances (promoting the development of cancer) hundreds of times over the legal limit in Shein clothing. Similarly, a European investigation into toys, baby products, electronics and cosmetics sold on Temu that breach European regulation, with one toy tested containing phthalates 240 times above the legal limit. (Phthalates can affect the function of organs and long-term can affect pregnancy, child growth and development and affect reproductive systems in both children and adolescents).
- Excessive Demand for Raw Materials and Textile Waste: The world consumes approximately 80 billion new clothing items every year – that is a lot of new clothes! Brands like Shein and Temu rely on this constant consumption to continue to make a profit, however there is only so much resource on Earth, and everything has to go somewhere. Estimates predict Shein alone produces nearly 200,000 new items each day. One of the ways countries have dealt with ultra fast fashion consumption is by shipping textiles overseas. Ghana receives 150,000 tonnes of used clothes dumped every year, with approximately half of these unusable. The clothing is commonly dumped and burnt, polluting local ecosystems with dangerous industrial chemicals, and damaging freshwater sources for local people. This exportation of textile waste is a new wave of ‘clothing colonization’, in which exponential consumption in the ‘Global North’ flows to the ‘Global South’.

How Are They So Cheap?
- Labour: The general rule is if you are paying an unbelievably low price for a product, the person making it has been paid an unfair wage for their labour. Often this means involvement of forced, child or penal labour and workers are subjected to awful conditions and chemicals. US lawmakers have previously warned of an ‘extremely high risk’ that Temu and Shein were using forced labour – for Shein this would look like as part of their supply chain manufacturing and Temu for offering products on their e-commerce site.
- Materials: Another huge sacrifice Shein and Temu make in a bid to keep prices extremely low yet profits up is with the quality, in particular the materials they use. The low-quality materials used and assemblage of items with little attention to longevity means the products often deteriorate and/or break quickly. But this is good news for Shein and Temu! Throwaway culture is how these platforms thrive, as they rely on our constant need to consume.
- Mode of production: Both Shein and Temy rely on high levels of consumption, to drive high levels of production, with a streamlined mode of production. This requirement for overconsumption is evident in marketing efforts on both brands’ platforms. I just switched my services over and there are some great alternatives, we have just been pre-programmed to use the American default brands.
Adobe, Microsoft, Apple, Google, Amazon all easy to replace.
The only challenging one so far is YouTube, content is just lacking elsewhere, but atleast with adblockers YouTube isn't getting my money.

The same should be done for corporate social media companies who basically deliver all or most news content and information to people everywhere today.
The current state of the world is like being in the 1900s and only having six major newspapers in the world owned by big corporations and none of the content they publish or share is regulated or controlled.
