Le truc qu'on vous demande de signer ces jours-ci pour interdire les thérapies de conversion dans l'Union Européenne, c'est pas une énième fucking pétition, c'est une initiative citoyenne européenne, c'est beaucoup plus utile et intéressant.

L'initiative citoyenne, c'est un mécanisme prévu par la constitution européenne qui permet aux citoyens de proposer une loi ou une modification de la loi existante à la commission européenne et au parlement européen.

Concrètement, ça veut dire que si l'initiative aboutit, la proposition législative sera examinée par la commission et présentée devant le parlement par le comité à l'origine de l'initiative.

Le dispositif de l'initiative citoyenne européenne existe depuis 2012. C'est pas un dispositif très utilisé, notamment parce qu'il est assez lourd : le comité qui propose l'initiative doit être composé de citoyen-nes d'au moins 7 états-membres, l'initiative ne doit pas être contraire aux valeurs de l'union Européenne, etc. Depuis 2012, seules quelques dizaines d'initiatives citoyennes européennes ont été lancées, et seules 7 ont obtenu le nombre de signatures nécessaires. Si l'initiative pour interdire les thérapies de conversion aboutit, ce sera la huitième ! 🥳

Et après, qu'est-ce qui se passe ? Eh bien honnêtement, la commission européenne peut tout à fait décider de répondre "Vu et s'en tape". C'est ce qui s'est passé par exemple en 2014 lorsqu'une initiative anti-avortement, l'initiative "un de nous", a obtenu les signatures nécessaires (la honte), et que la commission et le parlement ont poliment répondu qu'iels n'allaient pas donner suite.

Mais les mêmes peuvent également décider après examen qu'en effet, le problème soulevé par l'initiative justifie une modification de la législation. Par exemple, les propositions d'une initiative contre la souffrance animale qui a aboutit en 2018 sont en train d'être intégrées au droit européen.

L'ICE c'est un mécanisme qui n'est pas sans défaut, mais qui permet aux citoyens européens d'apporter des propositions devant les législateurs, et donc de faire évoluer la loi.

Bref, si vous êtes citoyen-ne de n'importe quel pays de l'UE, signez l'initiative ! 🙏

The text you are being asked to sign these days about banning conversion therapies in the European Union is not just one more petition: it is a European Citizens' Initiative, which is far more potent and relevant.

A European Citizens' Initiative is an instrument defined in the European Constitution, allowing citizens to submit a law or amendment to an existing law to the European Commission and the European Parliament.

Concretely, this means that if the Initiative succeeds, the legislative proposal will be examined by the Commission and submitted to the Parliament by the committee that launched it.

The European Citizens' Initiative system has existed since 2012. It is a relatively rarely used system, notably because it is rather demanding: the committee that authors the Initiative must comprise citizens from at least 7 Member-States, the Initiative must not infringe on the values of the European Union, etc. Since 2012, only a few dozen European Citizens' Initiatives have been attempted, and only 7 of these have succeeded in gathering the required number of signatures. Should the Initiative banning conversion therapies succeed, it would be the eighth to do so.

And after that, what next? Quite honestly, the European Commission could very well decided to answer "thank you, we don't care". This happened in 2014 after an anti-abortion Initiative, the "One of Us" Initiative, managed to gather the required signatures (shame!), and both the Commission and the Parliament politely declined to follow suit.

But the very same institutions can decide upon examination that, indeed, the question of the Initiative warrants modifying the law. For instance, the proposals from an Initiative against animal suffering, which succeeded in 2018, are currently being integrated into European law.

The European Citizens' Initiative is not without its weaknesses, but allows European citizens to bring proposals to their lawmakers, and thus to improve the law.

Anyhow, if you're a citizen of any country in the EU, do sign the Initiative!
