Un tribunal alemán afirma que la doctrina de Marx contradice el orden democrático
El Tribunal Administrativo de Hamburgo procesa a una asociación marxista y advierte que las enseñanzas de Marx "pueden chocar con la democracia constitucional alemana".
<p>El Tribunal Administrativo de Hamburgo resolvió el pasado 8 de abril que la asociación Marxist School of Politics and Culture Forum (Masch) no debe ser catalogada como "grupo extremista de izquierdas", anulando la inclusión de Masch en el informe de la Oficina para la Protección de la Constitución (LfV) correspondiente a 2021 y la revocación de su estatus de "entidad sin ánimo de lucro". </p><p>Eso sí, la decisión se basó en la ausencia de una “actitud militante activa” por parte de sus miembros, lo que, en palabras del tribunal, significa que "no suponen una amenaza para el orden constitucional alemán". Sin embargo, en la sentencia escrita publicada el pasado 10 de julio, el tribunal añade que las actividades centradas en la teoría de Karl Marx pueden ser “fundamentalmente incompatibles con el orden democrático básico libre de Alemania”, dado su objetivo de una transformación radical del sistema económico y estatal.</p><h2 id="la-dictadura-del-proletariado-en-el-punto-de-mira">La dictadura del proletariado, en el punto de mira</h2><p>El tribunal señaló que el problema principal radica en la centralidad de la figura de Marx en las actividades de Masch, subrayando que “la teoría social de Marx puede contener incompatibilidades en puntos fundamentales con los principios del orden democrático básico libre”. El texto fundamenta esta “advertencia” en que el concepto de “dictadura del proletariado” excluiría a otros grupos de la toma de decisiones políticas, por lo que lo considera “intrínsecamente antidemocrático”. Aunque la resolución oral de abril no explicitó este argumento, la sentencia escrita sienta un precedente de ilegalización del marxismo en alemania.</p><p>La defensa de Masch, encabezada por el abogado Ridvan Ciftci, calificó la argumentación judicial como “irresponsable”, alegando que implica que cualquier grupo centrado en Marx podría ser considerado inconstitucional y sujeto a vigilancia estatal. Ciftci sostiene que el fallo “es una amenaza potencial para todos los círculos de lectura de Marx en Alemania”, y que en este caso solo la “insuficiencia” o la “no militancia” protege a Masch de la ilegalización.</p><p>El caso de Masch contrasta con recientes sentencias de otros tribunales alemanes, como el Tribunal Administrativo de Berlín, que falló en favor del periódico Junge Welt y sostuvo que "una orientación marxista no equivale por sí sola a un intento de derrocar el orden democrático", considerando que “la revolución puede ser una transformación social radical pero constitucional”, mientras que Hamburgo concluyó que "el proyecto marxista persigue la revolución a través de la violencia". La controversia jurídica deja abierto el riesgo de que la vigilancia y la persecución estatal se extienda a otros entornos académicos o de militancia ligados a la doctrina marxista.</p><p>El fallo vuelve a poner en evidencia relación entre la democracia liberal alemana y el capitalismo. El tribunal de Hamburgo no aceptó que la Ley Fundamental alemana sea neutral desde el punto de vista económico, como argumenta la propia Masch citando al politólogo Wolfgang Abendroth. </p><p>Ante esta incertidumbre legal, los representantes de la asociación han anunciado que apelarán la decisión y organizarán un evento público para debatir sus implicaciones. </p>

<p>La Unión Europea está impulsando desde Copenhague la controvertida iniciativa <em>Chat Control</em> para imponer el escaneo obligatorio de todos los mensajes privados enviados a través de plataformas digitales, con el objetivo declarado de "detectar material ilegal", en lo que supondría uno de los experimentos de vigilancia masiva más extensos de "tiempos de paz" en el bloque. </p><p>La propuesta, guardada en el cajón por más de tres años, ha sido reactivada por la iniciativa de la presidencia danesa del Consejo de la UE, que presentó un nuevo borrador sin concesiones para las comunicaciones cifradas, contrariamente a la versión previa que contemplaba el "escaneo voluntario" o la exclusión de mensajes cifrados, según recoge el portal reclaimthenet.org.</p><p>Durante el debate del pasado julio en el Consejo, 20 de los 27 países miembros expresaron “reservas exhaustivas” respecto al texto danés, reflejando una división profunda entre estados. Mientras países como Italia, el Estado español y Hungría apoyan la vigilancia obligatoria sin reservas, París ha pasado de un apoyo tímido a una posición favorable, lo que podría inclinar la balanza de forma decisiva, dado que para bloquear la propuesta se requieren al menos cuatro países que sumen el 35% de la población de la UE. Sin embargo, Alemania se mantiene cautelosa y rechaza por el momento el escaneo de comunicaciones cifradas como una violación de derechos fundamentales.</p><h2 id="vigilancia-masiva">Vigilancia masiva</h2><p>El Consejo Jurídico de la UE advirtió hace tiempo que la propuesta colisiona con derechos humanos básicos, considerando que el llamado “escaneo desde el cliente” vulnera la privacidad sin importar la tecnología usada. Pese a las críticas generalizadas de expertos en tecnología, juristas y activistas por los derechos digitales, el avance de la medida parece depender más de prioridades políticas que de evidencias técnicas, con negociaciones previstas para septiembre y sin fecha concreta para su eventual adopción. Defensores del plan señalan "la necesidad de combatir amenazas y material ilegal", al tiempo que los opositores alertan de los riesgos sobre la ciberseguridad, la libertad de expresión y el derecho a la privacidad.</p><p>El exdiputado europeo Patrick Breyer denunció que varios gobiernos que se opusieron el año pasado a este tipo de control ahora están cambiando de postura, argumentando que “el plan 2025 es incluso más extremo”. Si París y Berlín finalmente respaldan esta iniciativa, la UE podría estar a punto de aprobar la inspección masiva de todas las comunicaciones privadas a nivel europeo, antes incluso de que cualquier medida de cifrado pueda proteger esos mensajes, lo que implicaría un cambio radical en la política de privacidad digital y en los derechos civiles y políticos.</p><p>El debate se produce en un contexto de máxima tensión geopolítica global y denuncias de recortes de libertades políticas y civiles en suelo europeo. Además, la eventual decisión de la UE tendrá repercusiones directas no solo en su población, sino en el modelo regulatorio que otros países podrían seguir en materia de vigilancia y privacidad tecnológica en la próxima década.</p>

Havia llegit la versió castellana i quan vaig veure que publicaven la versió catalana, no m'ho vaig pensar ni un minut. És un llibre revelador d'una Catalunya (que a la versió castellana insisteixen a amagar sota d'Aragó*) que no s'ajusta a les idees escampades per la pseudohistòria espanyolista que ens bombardeja cada dia.

La guerra entre el casal de Barcelona, entossudits a crear un espai català a la Mediterrània occidental i els Anjou, una branca de la corona francesa amb la intenció de posar el peu definitivament al Mediterrani per part dels francesos es barregen amb les intrigues papals i de les repúbliques del nord d'Itàlia en un conflicte permanent. Si hagués passat a Anglaterra ja faria segles que tindríem mil noveŀles i peŀlícules derivades d'aquest conflicte.

Però som catalans i Espanya amaga la nostra història.

  • La historiografia anglesa utilitza prioritàriament Corona d'Aragó, que reconeix, és nomenclatura construïda a posteriori dels fets ocorreguts. De totes maneres, el mateix Abulafia accepta les nomenclatures tradicionals de la historiografia catalana de fer servir Corona catalanoaragonesa, més moderna, però igualment acceptable. Dona gust que no t'escupin a la cara com solen fer els Cataluña-nunca-fue-reyno.

"The latest report released by GenCost has revealed that renewables remain the cheapest new-build electricity generation to 2050, even if they were to be rebuilt every 25 or 30 years.

GenCost, the annual collaboration between CSIRO and the Australian Energy Market Operator (AEMO), is used as a standardised measure by industry for forward planning and to assess the most economically viable investment opportunities."

"CSIRO and AEMO considered the claims about the life of nuclear reactors and capacity factors, rejecting the claim that these factors make nuclear cheaper.

The report found that renewables remain the cheapest new-build electricity generation in Australia to 2050, both as standalone assets and when also accounting for the required storage, transmission and firming."
