As I was laying awake in the middle of the night, thinking about the talk I agreed to give at the Ituna library next week about the SpaceX debris fall, I suddenly thought about the North Carolina campground that also found pieces of a Crew Dragon Trunk at the same time theglampingcollective.com/acti…
And I wondered... do they still have them? Did SpaceX ever offer to pick them up? (Probably not because they weren't obligated by an int'l treaty...)

SpaceX reps came and answered lots of questions, looked at the pieces and said "yep, you can keep them." Then the Australian Space Agency said "Nope, those belong to us" and took them away from farmers with no compensation. As a result, there are lots of pieces still out there.

(That was also how much they paid for the Starlink piece that was found in a different part of Sask a few months later, though they just had the farmer FedEx the piece to them rather than pick it up in a U-haul).
The Canadian Space Agency (as far as I know) wasn't involved in either exchange at all.

I hope farmers will feel comfortable telling me about them. But I don't have $5000 to give them, and I don't have a good way to get in touch with SpaceX (they don't want to talk to me), and CSA still doesn't have any official way to report space debris, though supposedly they're working on it. This is going to keep happening, and Canada should consider revising their doctrines about it.
Prof. Sam Lawler
in reply to WesDym • • •@wesdym So that's what I assumed also! But I tried to very gently ask one of the farmers who found space debris to carefully read anything that SpaceX asked him to sign and his response was "I AIN'T SIGNING SHIT". One other farmer I talked to who got paid also didn't sign anything.
I'm not sure what this means, it's all just very very interesting. (But yes, I agree Canada should be doing more!)
WesDym
in reply to Prof. Sam Lawler • • •I'm curious, too. Might be something buried in Canadian or provincial law that I'm unaware of.
In general, if you live in a common-law jurisdiction (which most of Canada outside of Quebec is), and you're offered money for something like this, there's a good chance you're sealing a deal you might or might know all about.
Prof. Sam Lawler
in reply to WesDym • • •WesDym
in reply to WesDym • • •Difficult to summarize, and I don't personally know of a single, concise, easily-digested source for this specific angle. But it is closely related to the common-law 'peppercorn' doctrine, discussed here:
en.wikipedia.org/wiki/Pepperco…
Basically, it's about how contracts work under CL. Generally speaking, if you're fully informed and accept payment, you seal a contract by that. It's why some parties in CL jurisdictions won't accept even partial payment, if they feel there's dispute.
very small payment offered as consideration to satisfy legal requirements for a valid contract
Contributors to Wikimedia projects (Wikimedia Foundation, Inc.)WesDym
in reply to WesDym • • •There are two major angles on this: consideration (payment) to seal a contract, and accepting consideration as evidence of accepting the terms of a contract.
This is why you'll see so many conveyances in the US for $1 (such as parents giving their homes to their children); that 'peppercorn' is material consideration, affirming that an actual conveyance took place. I know it seems silly, but as I said, this is ancient CL doctrine.
/cont-2
WesDym
in reply to WesDym • • •2/ Going the other way, if you ACCEPT payment, then under most CL interpretation, you accept the terms that payment refers to.
This came up in a thread just yesterday, in which the UK is paying off some immigrants to just leave. Whether they know it or not, by accepting that money, those people AGREE to whatever terms were associated with those payments. It's a way for the Crown to save money and hassle, paying people off to bar them from further litigation.
/3
WesDym
in reply to WesDym • • •3/ Another example: In the US, if you agree to join a settlement in a class-action lawsuit, you can get a guaranteed payout, but by accepting that you ALSO waive any OTHER chance at suing that same party over the same damages. (You only get one bite at the apple, and if you accept on, you foreclose all others that might be available to you otherwise.)
This is what I suspect is going on here: If you accept the money from SpaceX, you can't later sue them.
Prof. Sam Lawler
in reply to WesDym • • •WesDym
in reply to Prof. Sam Lawler • • •Well, it's evolved legal doctrine. CL is the prevailing system of doctrine in, pretty much, the anglophone world. It is of course not identical among them. But they do share core doctrines like this.
My own view is, if you're a legal adult in Canada, and SpaceX offers you $5K and you take it, whatever follows is on you. At some point, legal adults have to accept responsibility for themselves, and I don't have a ton of sympathy for those who reason like children.
