I skimmed and it's pretty much throughout the whole thing. They have a LOT in there, but here's one:

"the Bureau is proposing to delete language in § 1002.6(a) and its accompanying commentary indicating that disparate-impact liability, which is referred to in the rule as the β€œeffects test,” may be applicable under ECOA, and add language stating that the Act does not recognize the β€œeffects test.”"

@violetmadder @rjblaskiewicz @glitzersachen My understanding of this is that so long as the written policies of the financial institutions do not specifically tell employees to discriminate based on any of the protected classes no amount of proof that they are actually discriminating will allow a claim.

Basically, you can’t sue if they don’t admit to the discrimination in writing.

I'm an old guy, born and raised in a Segregated State. Parents worked and lived thru The Great Depression. My oldest brother, a young boy at the time, told me what it was like. It was an example of across the board restricted living with POC being at the bottom of the barrel. I see nothing different in the current republican admin. to make me believe their aim is to be any different.

i've read the Notice of Proposed Rulemaking, and I don't see that. I DO see strong hints of trumpy anti-DEI shit, but it doesn't appear to single out women. If you can point me to that part of the NPR, cool.
