It's not an ethical dilemma. If a HUMAN driver got into a situation where they had to choose between hitting and killing a granny or baby, we'd rightly jail them for many years for reckless/dangerous driving.
A self-driving vehicle should be incapable of operating in a manner equivalent to a reckless human driver.
If a self-driving vehicle is capable of getting into such a situation, the car manufacturer is responsible for a crime of homicide and should be punished.

However I would expect¹ permanent circumstances such as a tight curve or a pedestrian crossing to be properly indicated in advance with signs and, if needed, a lower posted speed limit, and to have to adapt myself to circumstance that are changeable, such as the weather or works (these should come with a lower posted speed limit, tbf) or the road being full of protestors or whatever.
¹ not that I'd *trust* them to always do it. posted speed limits in Italy tend to be chosen by mysterious processes, in many cases

in reply to Charlie Stross • • •Rules of the road quite clearly state that you must be able to stop in the length you can see *at any time*. If the car was going faster than sensor distance / breaking time, it was breaking the law.
And, fun fact, since it was obviously programmed to do that, it wasn't just breaking the law at the time it crossed the speed threshold, but from the very beginning.
An autonomous car that is even capable of hitting a stationary target is not street legal, by definition.

(It's not just humans entering the road, either: it could be another vehicle, possibly out of control.)

in reply to Charlie Stross • • •@henryk to an extent I agree, but unlike the "able to stop in the distance you can see to be clear" one, "able to stop if something comes from behind any object" is not a requirement we apply absolutely to human drivers.
I think it's a question of reasonableness vs recklessness. You don't overtake on a blind corner. But you also don't slow to <3mph to avoid potential injury every time you pass a parked van.

in reply to Simon Waldman • • •@swaldman Reasonableness isn't really relevant. I'm not sure how this is applied if a person breaks the law when crossing, but if there's a cross walk, and you can't see clearly if someone is about to cross, slowing down *is* a reasonable requirement.
In my neighbourhood roads narrow to a single lane at bus stops to force slow driving. I always drive very carefully past the bus sheds because a child can decide to run from one to another and I absolutely want to be able to stop. @cstross @henryk

At designated crossings, I agree with you.
But at other locations? You wouldn't be able to exceed 5 mph through most of many urban areas! (bear in mind that in the UK it is entirely legal to cross the road anywhere you like. Plus, even if not legal, that doesn't mean a kid won't do it at speed...)

But what would you say is a reasonable speed here? Any one of those cars could be hiding a kid about to run out. The vans and SUV could be hiding adults. To be sure of being able to stop for any of them, we're probably limited to a walking pace.
I think most people would think 20-30 kph was "reasonable" here, even though they couldn't guarentee being able to stop for an unexpected sprinter who hasn't looked for traffic.

in reply to Simon Waldman • • •@swaldman I slow down anywhere where there is a possibility to be children or pets I can't see clearly. Whether it's a parked car, a fence, or a bush. Through my own street I slow down significantly at any such places. The speed limit is 30, but the straight parts are built as a single lane here too to force cars to slow down.
Where the speed limit is higher, there are usually also no obstructions like that close to the road. At least not around here.

There are lots of really good and challenging ethical questions even when the car is operating legally and safely, most of which also apply to a human operator. It’s irritating that the trolley problem is the only way journalists seem to want to frame it.
