A few days ago, Irreal (are they on the fediverse?) posted a blog about RSI and Emacs. As usual, very interesting thoughts on Emacs.

They expressed surprise at the number of long-time Emacs users (those using Emacs 30-40 years) that had not suffered from RSI. I wonder whether one reason for that is many of us old-timers might not use significant amount of chording beyond C- (whose impact we can alleviate by switching CAPS LOCK with CTRL, of course). For instance, I usually use `ESC b` for `backward-word` instead of `M-b`. I find it much easier (on my hands) to hit the ESC key and then put my hands back on the home row for the next letter.

Just musing.

Full disclosure: my RSI, when I suffered from such many years ago now, came from mouse use and not Emacs. I no longer use the mouse and, funnily enough, this is where Emacs wins big time!

Crappy mouses are a pain.

I've spent, years ago, some good money on an evoluent vertical mouse 4.

Best money spent ever.

I used to also have some minor pain due to the mouse, but I noticed that it was because:

  • The mouse was always too small.
  • The wrist was pushing down the table, causing pressure on the carpal region.

Buying a good vertical mouse, rightly sized along with a good keyboard made miracles
for me.

Germania e consumo di birra.


Sto leggendo alcuni dati sul consumo di birra in Germania, in netto calo ormai da diversi anni, e devo dire che mi lascia sempre perplesso la superficialità con cui la stampa, specie quella italiana, affronta l’argomento.

Naturalmente, essendo la stampa italiana quel che è — oramai ridotta a una sorta di bollettino dell’Alt-Right in salsa provinciale — la questione viene subito incanalata nel solito binario stantio dell’“identità nazionale minacciata”, del “tradimento delle radici”, e via delirando.

Peccato che il vero problema non venga nemmeno sfiorato. E sì, perché esiste eccome una correlazione solida, lampante, quasi banale, tra il crollo del consumo di birra e un altro fenomeno che sta assumendo proporzioni catastrofiche in Germania (e non solo): la pandemia silenziosa del diabete di tipo 2, che ormai dilaga in tutta Europa come un incendio.

Il meccanismo è semplice, quasi noioso, eppure nessuno sembra volerlo spiegare chiaramente: chi riceve una diagnosi di diabete mellito di tipo 2 si ritrova, da un giorno all’altro, con una serie di restrizioni ferree, a partire dall’alcol.

In Germania, appena scatta la diagnosi, il medico di base comunica il tutto alla Krankenkasse — la mutua semiprivata che si usa qui, per capirci — che avvia il protocollo standard. E da quel momento scatta la giostra:

  • Visite regolari (pagate) dall’endocrinologo o diabetologo, dal dietologo e dal nefrologo.
  • Esami del sangue trimestrali, sempre a carico della cassa malattia (e spesso direttamente dal medico di famiglia).
  • Controlli annuali obbligatori agli occhi e ai piedi, due tra gli organi più colpiti dalle complicanze diabetiche.
  • E, se c’è sovrappeso — cosa che accade nella maggior parte dei casi — arriva puntuale la prescrizione del famigerato Ozempic o di farmaci analoghi.

Ma la parte che qui interessa davvero è il trattamento dietetico. Il dietologo non si limita a quattro raccomandazioni generiche: ti consegna un protocollo dettagliato, con tanto di lezioni e corsi obbligatori, su cosa e come si debba mangiare in presenza di diabete di tipo 2.

E tra le tante limitazioni, c’è ovviamente quella sull’alcol: la birra è ammessa, sì, ma con una frequenza ridicola.

Una porzione ogni quindici giorni. Ripeto: un solo boccale di birra ogni quindici giorni. E nemmeno il boccale da un litro, quello delle feste bavaresi, ma il “normale” mezzo litro, la classica pinta.

Stop. Fine dei giochi.

Ora, ditemi voi come possa reggere il mercato della birra in un paese dove il diabete di tipo 2 sta letteralmente esplodendo e dove centinaia di migliaia di persone ogni anno vengono sottratte alla platea dei bevitori abituali per motivi medici.

Ma si sa, questo ragionamento non fa abbastanza click. Meglio piangere sull’identità perduta.


Forse non sono chiare le dimensioni del fenomeno. Secondo il Robert Koch institut, ogni anno vengono diagnosticati in germania ben 500.000 NUOVI casi di diabete mellito, con un totale di OTTO MILIONI di affetti.

Non e' un fenomeno nuovo, nel senso che in Italia la situazione e' a sua volta esplosiva:

(dati INPS).

  • Nuovi casi ogni anno: 200.000–250.000.
  • Casi noti totali: circa 3.900.000.
  • Casi sommersi: circa 1.500.000.
  • Totale stimato: circa 5.400.000.

Tutti questi casi sono casi nei quali viene vietato il consumo di vino, alcoolici e birra.

Su scala europea, gli ultimi dati di IDF , la situazione e' questa:

  • 2021: circa 61,4 milioni di adulti affetti da diabete in Europa (fascia 20–79 anni), pari a un prevalenza del 9,2 % della popolazione adulta
  • 2024: stima aggiornata a 65,6 milioni di diabetici, con prevalenza prossima al 9,8 % .
  • 2050 (proiezione): previsti 72,4 milioni, con prevalenza salda al 10,4 %

Come potete vedere, l'epidemia e' ESPLOSA tra il 2000 e il 2011, e ora semmai sta rallentando. Ma cosa e' successo di preciso tra il 2000 e il 2011? Facciamo un elenco:

  • Accordi di libero scambio UE con Messico (2000), Cile (2003) e in progress Mercosur: hanno facilitato l'importazione di grandi quantità di zucchero, oli vegetali, cereali raffinati e alimenti trasformati a basso costo, abbassando i prezzi sul mercato europeo. Questo ha favorito la disponibilità di snack, bevande zuccherate e prodotti ultralavorati.
  • Le riforme PAC dal 2000 in poi hanno incentivato colture intensive di mais, soia, zucchero e oli vegetali (ad esempio colza), materie prime fondamentali per la produzione di alimenti ultralavorati (snack, dolci, bevande, cibi pronti).
  • Il Regolamento UE 1924/2006 sulle dichiarazioni nutrizionali e salutistiche, pur volendo regolamentare le informazioni al consumatore, ha in alcuni casi permesso il marketing di prodotti “light” o “senza zucchero aggiunto” che però restano ultralavorati e con ingredienti diabetogeni nascosti.


Conclusione


La combinazione di:

  • liberalizzazione del commercio di materie prime zuccherine e oli
  • sovvenzioni agricole che mantengono bassi i costi di cereali raffinati, zucchero e oli vegetali
  • regolamenti che hanno facilitato la produzione e la circolazione di alimenti ultralavorati
  • normative su etichettatura e marketing spesso insufficienti a limitare prodotti iperprocessati con claim fuorvianti

ha creato un terreno perfetto per l’aumento del consumo di cibi diabetogeni in Europa tra il 2000 e il 2011.


Ovviamente, l'accusa e' molto grave, quindi vorrei circostanziarla un pelino di piu', e metterci delle fonti.

L’aumento dei cibi ultralavorati in Europa (2000-2011): il ruolo delle leggi e dei trattati


Negli anni tra il 2000 e il 2011 l’Europa ha assistito a una crescita significativa del consumo di cibi ultralavorati: prodotti confezionati, ricchi di zuccheri, grassi raffinati e additivi. Questi alimenti sono strettamente legati all’aumento dell’obesità e del diabete di tipo 2, una vera e propria epidemia che ha colpito il continente in quegli anni (Monteiro et al., 2013; WHO, 2016).

L’aumento dei cibi ultralavorati


  • La disponibilità e il consumo di alimenti trasformati e ultralavorati, come snack dolci e salati, bevande zuccherate, prodotti da forno industriali, sono aumentati in modo esponenziale tra il 2000 e il 2011 in Europa (Monteiro et al., 2013; Moubarac et al., 2017).
  • Studi epidemiologici mostrano che questo tipo di dieta ipercalorica, povera di nutrienti essenziali, è uno dei principali fattori scatenanti del diabete di tipo 2 (Hu, 2011; Malik et al., 2010).


Cambiamenti normativi e commerciali che hanno favorito questa diffusione
1. Liberalizzazione del commercio internazionale di materie prime zuccherine e oli vegetali


  • La stipula di accordi di libero scambio tra UE e Paesi come Messico (2000) e Cile (2003), nonché l’intensificazione dei negoziati con Mercosur, ha facilitato l’importazione di zucchero, oli vegetali (colza, soia) e cereali raffinati a prezzi bassi (European Commission, 2010).
  • Questi ingredienti sono la base di gran parte dei cibi ultralavorati: snack, dolci, bevande zuccherate, e pasti pronti industriali (Monteiro et al., 2013).


2. Politica Agricola Comune (PAC) e le sue riforme


  • Le riforme della PAC nel periodo hanno sostenuto colture intensive di mais, soia, zucchero e oli vegetali, grazie a sovvenzioni che hanno mantenuto bassi i costi di queste materie prime (European Parliament, 2008).
  • Queste sovvenzioni hanno spinto l’industria alimentare verso la produzione di alimenti processati e ultralavorati, spesso ricchi di zuccheri e grassi insalubri (Moubarac et al., 2015).


3. Normative europee sulla sicurezza e igiene alimentare


  • L’entrata in vigore del Regolamento CE 178/2002 e del pacchetto igiene del 2004 ha imposto standard più rigorosi, garantendo sicurezza e tracciabilità ma anche facilitando la produzione industriale su larga scala di alimenti confezionati e ultralavorati (European Food Safety Authority, 2005).
  • Questo ha creato un ambiente normativo favorevole all’industria alimentare industriale, che ha potuto espandersi e standardizzarsi a livello europeo (Monteiro et al., 2013).


4. Regolamentazione su etichettatura e marketing (Regolamento UE 1924/2006)


  • Sebbene volto a tutelare il consumatore, il regolamento ha permesso a molti prodotti ultralavorati di essere commercializzati con claim salutistici (es. “light”, “senza zuccheri aggiunti”) spesso fuorvianti, incentivando il consumo di questi alimenti (Hawkes, 2004).
  • Mancano ancora regole sufficientemente severe per limitare la pubblicità di cibi ad alto contenuto di zuccheri e grassi, specialmente verso i bambini (WHO, 2016).


5. Aumento dell’importazione di OGM come materia prima


  • L’import massiccio di soia OGM per mangimi e uso alimentare ha favorito la produzione di oli e farine a basso costo utilizzati in alimenti ultralavorati (European Commission, 2007).
  • Anche se l’uso diretto di OGM in alimenti è regolamentato severamente, l’industria si è basata su materie prime a basso costo per alimentare la produzione di massa (EFSA, 2009).

Conclusioni


Tra il 2000 e il 2011, l’insieme di questi cambiamenti giuridici e commerciali ha creato un terreno fertile per la rapida diffusione di cibi ultralavorati ad alto contenuto zuccherino e calorico in Europa. La liberalizzazione del commercio, le politiche agricole, e le normative su sicurezza e marketing hanno reso questi prodotti più accessibili, più economici e più pubblicizzati. Tutto ciò ha contribuito in modo decisivo all’aumento dell’epidemia di diabete di tipo 2 nel continente (WHO, 2016; Monteiro et al., 2013).

Queste norme, spesso etichettate come “Food Safety Standard”, sono state indicate da diversi studi come fattori che hanno contribuito all’epidemia di obesità e di diabete mellito di tipo II (Swinburn et al., 2011; Monteiro et al., 2013).

Un punto fondamentale da chiarire: il diabete mellito di tipo II non è un problema di carenza di insulina. L’organismo produce insulina, eccome. Il vero problema è l’insorgenza di una insensibilità all’insulina (resistenza insulinica), che impedisce al corpo di utilizzare efficacemente l’insulina prodotta (Kahn et al., 2006).

Per questo motivo, chi viene diagnosticato con diabete di tipo II generalmente non ha bisogno di iniettarsi insulina. La terapia si concentra invece sul migliorare la sensibilità del corpo all’insulina, attraverso farmaci orali come la metformina, che agisce riducendo la produzione epatica di glucosio e migliorando la risposta periferica all’insulina (UKPDS Group, 1998; Rojas & Gomes, 2013).

La cosa paradossale e' che si sta verificando un effetto selettivo. Cioe', succede cosi':

  • Le nuove leggi facilitano la diffusione di alimenti diabetizzanti, e di ultralavorati.
  • Arriva puntuale l'epidemia di diabete di tipo II.
  • I diagnosticati vanno dal dietologo.
  • Il dietologo vieta alcool, alimenti diabetizzanti, e ultralavorati.


Risultato: come effetto collaterale, i consumi di vino e birra si fottono.


Ma si fottono anche i consumi di bevande gassate molto zuccherine, e non di poco. Faccio presente che, secondo i dati europei che ho esposto, oggi c'e' un DIECI PER CENTO di adulti che quella roba non la mangia e beve piu', per la semplice ragione che la prima cosa che fanno una volta diagnosticati e' di andare da un dietologo, o anche da un normale medico generico, che gli vieta proprio di mangiare quella roba.

E quindi, tirare fuori l'identita' tedesca, o italiana, non serve a nulla: si chiama Karma. Avete dato merda da mangiare alla popolazione, per aumentare di un cinque per cento le vendite, e ora vi beccate un dieci per cento di cazzotto nei denti.

Ah, si'. E' cronico. Non se ne va. Il danno e' irrimediabile.

Today, 10 July 2025, in a pivotal judgment, the Grand Chamber of the European Court of Human Rights (ECtHR) ruled in the case of Semenya v. Switzerland. The Court overturning its Chamber judgment of 11 July 2023 found a violation of Article 6 § 1 (right to a fair hearing) of the Convention, but held that there was no territorial link between Switzerland and Caster Semenya in respect of her other complaints under Articles 8 (right to respect for private life), 13 (right to an effective remedy) and 14 (prohibition of discrimination) of the European Convention on Human Rights, declaring them, therefore, inadmissible.

The Court found, within the meaning of Article 1, that Semenya did not fall within Switzerland’s jurisdiction in respect of Articles 8, 13 and 14, on the grounds that the applicant is a South African national and the sports federation in question (World Athletics) has its seat in Monaco. The Court only acknowledged Switzerland’s jurisdiction as it applies to Article 6.

Impact of the Grand Chamber’s decision


We welcome the Grand Chamber’s finding of a violation of Article 6 § 1. A majority of judges concluded that Semenya had not benefited from the safeguards provided for in Article 6 § 1 to ensure her right to a fair hearing. The Court found that the Swiss Federal Supreme Court failed to undertake the required rigorous judicial review in light of the seriousness of the personal rights at stake in the case, namely the impact of the contested “Eligibility Regulations for the Female Classification (Athletes with Differences of Sex Development)” (“DSD Regulations”) on Semenya’s bodily and psychological integrity and identity, right to self-determination and right to exercise her professional activity.

We regret that the Court has failed in its obligation to protect fundamental rights by choosing not to examine the merits in question of Semenya’s claims of violations of her rights as guaranteed by Articles 8, 13 and 14 of the Convention. We highly welcome the partly dissenting opinions of judges Bošnjak, Zünd, Šimáčková and Derenčinović, who state that it is “inconceivable that domestic courts, ruling within the territory of Europe, should disregard international fundamental rights obligations in area of protection of bodily integrity, equality and human dignity”.

As highlighted by judges Bošnjak, Zünd, Šimáčková and Derenčinović in their partly dissenting opinion, “The Court’s role is to protect fundamental rights. In choosing not to examine on the merits the question of the applicant’s rights as guaranteed by Articles 8 and 14 of the Convention, the Court has failed to fulfil its role in the present case.” The four judges, however, fully endorse the view of the Chamber and the majority of the Grand Chamber that Switzerland cannot be held responsible for the content of the DSD Regulations, since it played no part in their adoption. However, they state that positive obligations under Article 8, taken alone and in conjunction with Article 14, include an obligation to put in place both a legal framework to protect private life against interference by private persons and a remedy capable of providing sufficient protection.

We are further encouraged by Judge Šimáčková partly concurring opinion in which she states, “In conclusion, I should like to emphasise that the applicant was at a disadvantage vis-à-vis the IAAF, not only as a professional athlete, for the reasons set out in the present judgment, but also because she is a woman, she is black, and she is from the Global South”. These are significant considerations that the Grand Chamber seems to have disappointingly overlooked.

If national courts of States such as Switzerland which house major international sports governing bodies, including the International Olympic Committee, and many major international sports federations, do not have a positive obligation to uphold fundamental rights, specifically with respect to the present case vis-a-vis Articles 8, 13, and 14 of the Convention, then we ask, who does?

ICJ Africa Director, Kaajal Ramjathan-Keogh, stated, “The ICJ is deeply disappointed by the outcome of this case. Our joint intervention submitted that the DSD Regulations fall foul on sex characteristics as a ground for discrimination without ‘particularly weighty and convincing reasons’ by way of justification and, as a result, impermissibly discriminate against intersex athletes under Article 14. We urged the Grand Chamber to uphold the findings in the Chamber judgment establishing sex characteristics as a prohibited ground under Article 14 of the Convention. Sadly, the Grand Chamber has elected not to do so”.

“It is deeply disappointing that the Grand Chamber judgment fails to fully uphold the rights of intersex athletes,” says Dan Christian Ghattas, Executive Director of OII Europe, “The Court did not recognise that Semenya was excluded from her profession in application of blatantly exclusionary, invasive and discriminatory regulations, which are not backed by any solid evidence that could justify this difference in treatment. This is especially concerning in light of the Chamber decision of 11 July 2023, which had acknowledged this reality. However, we hope that the case will be reopened before jurisdictions in Switzerland, echoing Caster Semenya’s own words that this will hopefully pave the way for all athletes and inspiring young women to be and to accept themselves in all their diversity”.

“It is concerning that the Court fails to address the essential issues of discrimination that intersex athletes continue to face under the ‘DSD regulations’, whose impacts trickle down to grassroots level sports, limiting the ability of all intersex people to participate freely in sports, including at amateur level where the majority of sports participation lies”, says Urs Vanessa Sager, OII Europe Consultant on sports.

Katrin Hugendubel, ILGA-Europe Advocacy Director, says, “In finding that the Swiss Federal Court failed to conduct a rigorous judicial review of her case, the Court has clarified that the right to a fair trial indeed extends to sports arbitration – this is an important result, and we urge the Swiss court system to act swiftly and in line with international human rights standards.”

Facts of the case:

Caster Semenya – a South African international-level middle-distance athlete – was forced to stop participating in elite-level competitions following the International Association of Athletics Federations’ (now World Athletics), “Eligibility Regulations for the Female Classification (Athletes with Differences of Sex Development – the DSD Regulations)” requirements, which would have forced Semenya to undergo hormone treatment to decrease her natural testosterone level in order to qualify for the female category. Semenya refused this. Her failure to comply with the regulations directly resulted in her being barred from competing at the international level. In 2020, the Court of Arbitration for Sport (CAS) and the Swiss Federal Court had dismissed her requests for arbitration, concluding that the DSD Regulations were “a necessary, reasonable and proportionate means of achieving the IAAF’s aims of ensuring fair competition”.

Following these developments, in February 2021, Semenya filed an application with the ECtHR. In its judgment of 11 July 2023, the Court held, by a majority, that there had been a violation of Article 14 (right to freedom from discrimination) taken together with Article 8 (right to family and private life) of the European Convention on Human Rights. The Court found that Switzerland had failed to provide institutional and procedural safeguards enabling an effective examination of Semenya’s complaints before domestic authorities, who failed to properly examine Semenya’s well-founded and credible claims of discrimination on the basis of her sex characteristics.

In 2023, Switzerland requested that the case be referred to the Grand Chamber of the ECtHR. In January 2024, OII Europe, ILGA-Europe and the International Commission of Jurists (ICJ) filed a joint third-party intervention to assist the Grand Chamber in its determination of the case. The submission focused on the place of intersex athletes in competitive sports, analysing World Athletics’ constantly evolving rules, which – due to their strict prerequisites – effectively limit and/or prevent the participation of intersex athletes in international sporting competitions.

Then he says that his point is not about blocking support for Ukraine, implying that it’s not really Ukraine’s fault, but getting Poland’s relations with countries like Germany and the US who never miss opportunity to play hard, but often forget about their obligations.
