verstehe oft nicht die Aufregung dabei.
Bei den billigen Preisen ist das doch zu erwarten. Da wird jedes Glied in der Verwertungskette gnadenlos ausgebeutet. Der Hersteller, die Umwelt, der Lieferdienst, die Kundendaten.
Sobald der Verkauf einmal abgeschlossen ist hat Temu das Geld. Warum anschließende Service annieten oder sich an Gesetze halten? Bis da ein Urteil ergangen ist, kann man jahrelang weiter Geld verdienen.

Mit maßgeblicher Beteiligung von Frontex hat die EU-Kommission in den vergangenen 17 Jahren mehr als 800 migrationsbezogene Projekte zur Sicherheitsforschung gefördert. Damit sollen die Außengrenzen technologisch auf den neuesten Stand gebracht werden.

Laut einer Studie verzögert sich das Vorhaben der Bundesregierung, bis 2030 alle deutschen Haushalte mit Glasfaser zu versorgen. Faktoren seien Schwierigkeiten beim Ausbau auf dem Land und eine Telekom, die ihre Marktmacht missbraucht, um den Ausbau der Konkurrenz zu verlangsamen.

wenn die sozialen Netzwerke ungebremst Vorschub leisten und darüber hinaus missbräuchlich nicht nur von den Usern verwendet werden, muss die Gesellschaft davor geschützt werden und die Auslieferung von Inhalten beschränkt oder der Zugriff gar ganz gesperrt werden.

Das mag so stimmen, aber ist dennoch zu einfach!
Denn wahr ist auch, dass Propaganda nur dann funktioniert, wenn der Staat intransparent ist und die Regierung unsozial arbeitet.
Solange wir keine Transparenz haben, ständig von unten nach oben umverteilt wird, grundsätzliche Existenzängste bei vielen herrschen und Armut & Bildung - vor allem bei Kindern - in einem so reichen Staat ein Thema ist, hat es Propaganda leicht!

If confirmed, Brunner would lead DG HOME, the Commission unit that'll propose laws on data retention, encryption & other surveillance issues.
In short, the topics most relevant to EDRi's mission to stop discriminatory & arbitrary #StateSurveillance will fall to him!

As Commissioner, he would have the opportunity to ensure that #AIAct implementation follows international human rights standards for people at EU borders, and to protect encryption from chat control or the #GoingDark group.

Brunner's opening is a practiced exercise in balance & euphemism. He puts forward a "firm" approach to migration & "returns", and sets his top priority as developing an EU Internal Security Strategy. He's open to "new ideas" for the Migration Pact (EU-speak for externalisation).

He simultaneously posits himself as a champion of rights: "We must manage our border the #EuropeanWay, in full compliance with fundamental rights". BUT...

🚨 Policing the net: the MEP grilling kicks off with the Conservatives asking about organised crime.

Brunner points to the recommendations of an EU police group called #GoingDark (which has been strongly criticised by EDRi). Despite a nod to the importance of upholding CJEU case law, he makes a deeply worrying comment about obliging companies to break online anonymity. We'll be watching with concern 👀

Better regulation: it's good to see Greens MEP Saskia Bricmont challenge the Commission's systemic failure to fulfill their own 'better regulation' commitments for Home Affairs laws, e.g. no Impact Assessments for the Facilitators package.

But worryingly, Brunner says this will not be possible in all cases, and that he cannot make such a commitment to future Impact Assessments.

Europol: Bricmont also rightfully points out that the Commission still has not delivered the evaluation of #Europol's 2016 reform - 2 years after the deadline. When can we expect it then, she asks? Brunner remains silent, declining to commit that procedural problems would be rectified.

Meanwhile the Commission has since put forward two (!) mandate reforms massively expanding Europol's powers, rubber-stamping the agency's rogue data handling & without solid evidence.

Privacy: 2+ hrs into the hearing, protecting #encryption, #privacy & stopping #spyware are finally raised, thanks to S&D's Kaljurand. But Brunner's response pits safety against privacy - a common trope of the outgoing Commissioner.

What's more, despite an outright ask for him to commit to protecting #E2EEncryption, Brunner skirts the question. A silver lining? He compliments the Parliament's position on the #CSAReg, which rejected the Commission's mass surveillance and encryption-breaking plans

"Migrant smuggling": Brunner calls for new partnerships w/ 3rd countries, and support for law enforcement & Europol.

In line with the Commission proposal currently on the table, that would mean even more #biometric data processing & exchange, without reinforced supervision.

Europol: Brunner says he shares the Conservative group's view of #Europol as a "success story" and its wish that the agency becomes "more operative & effective" in the future. How? With a bigger budget and double the staff.

Chat control: thanks to a punchy question from the Greens group's @MarketkaG, Brunner was put on the spot for evading Kaljurand's earlier qn on whether he will protect encryption in the #CSAReg.

Sadly, another non-answer: we need a balance of privacy and protection (blah blah).

Moreover, Brunner seemed to deliberately ignore Gregorová first question on spyware, despite it being clear as water: "How will you make sure that the EP PEGA Committee recommendations are followed?".

Brunner's answer was a VERY loud - and telling - silence.

As the hearing comes to its conclusion, a loud and telling silence seemed to be the order of the evening. On almost all #DigitalRights topics, the Commissioner-designate evaded, avoided or outright ignored questions from MEPs.

It's a polished start for Commissioner-Designate McGrath as he says that his portfolio sits at the "core" of what the #EU stands for. He shows off his credentials as a national Parliamentarian and politician with 25 years of experience.

However, he's already talking about the importance of "competitiveness" - something that EDRi has worried was given too much prominence in McGrath's written answers to the Parliament. Competitiveness should not be the goal of the Justice and Rights Commissioner!

The Commissioner-designate adds that he wants to be an honest broker who engages with CSOs and people "on the ground" - music to our ears? 🎵 He also commits to launch infringement proceedings for breaches of the Charter of Fundamental Rights. But time will tell if he can deliver on this promise....

A super hot topic 🔥: the #GDPR. McGrath hails the law as a "success", but the first MEP question from the EPP Group attacks this vital data protection law, asking McGrath how he plans to "overcome" (!) it!

Luckily McGrath doesn't take the bait, instead stating that "I do not believe that it [the GDPR] is contradictory to ... fostering and supporting innovation." 🥳 This is an important statement and push-back against the toxic political narrative that protecting people's rights is a 'barrier'!

Next, the Socialists & Democrats (S&D) group questioned McGrath about safeguarding privacy & data protection, especially in the context of the #EU's data transfers agreements with third countries, some of which were struck down by the Court of Justice in the past. He was also questioned about the foreseen future data retention proposal ( a big 🚩red flag for EDRi!) and how to ensure it complies with CJEU case law. As he gave no reply to those questions, we hope another MEP will raise them!

A far-right MEP brings the hyperbolic German debate and fearmongering about the #DigitalServicesAct and #FreedomOfExpression into the room. Good to see that McGrath is informed enough to realise that while free speech must be protected, the #DSA isn't what's threatening it!

McGrath has repeated several times that he will use the whole "EU toolbox" to protect rule of law, including infringement procedures. It's been over 10 years since the CJEU invalidated the #DataRetentionDirective.

Yet national data retention laws transposing it are still in place in the majority of MS (!) This is against EU law. The EC never lifted a finger to address this rule of law crisis. Will McGrath have the necessary courage where so many before have wilfully failed to act?

I did not hear an answer by McGrath on the respective question by MEP Konstantinos Arvanitis regarding spyware and #predator. Do you know if I missed it or was there no specific answer to that?

After a question from the conservative EPP group, McGrath confirms he'll use the #DigitalFairnessAct (DFA) to tackle barriers to protecting people as consumers, especially safeguarding minors from unfair marketing techniques like in-app sales & gambling-like features in video games.
We call on the Commissioner-designate to use the #DFA to also address the massive gap in regulating #SurveillanceAds and pervasive online #tracking that continues to undermine everybody's #privacy online!

Platform regulation: MEP Katarina Barley from the S&D group says the quiet part out loud: we need to tackle #BigTech's business model which harms not only minors online, but everybody!
McGrath seems to be aware of Big Tech's toxicity, but will he commit to curbing their power? His answer did not tell us much.

More non-answers on platform reg: McGrath confirmed his agreement with Green MEP @kimvsparrentak's goals to better protect people against addictive designs by digital services. Unfortunately, he did not respond to her demand that he commit to ban these harmful practices.

It's groundhog day: we are back to MEPs asking the Commissioner-des for JUSTICE and RIGHTS what he will do for COMPETITIVENESS, GROWTH and INNOVATION. He commits to "reducing red tape" 🤦, but (small concession) at least says he will do it in a way that "doesn't dilute rights".

Data Protection: MEP Barrena addresses head-on the absurd renewal of the EU's Adequacy decision with Israel, despite ICJ investigation into possible genocidal actions in Gaza, thus legitimising Israel as an EU partner and normalising its mass surveillance regime - a decision that EDRi criticised in depth: s.42l.fr/abZDK1Uj. McGrath dodged the question, reaffirming the Commission's ultimate goal to favour trade with as many 3rd countries as possible over protecting fundamental rights.

Die KI-Verordnung ist zwar fertig, aber was sie genau bedeutet, das ist noch lange nicht ausgehandelt. Für KI-Modelle wie ChatGPT fehlen noch sogenannte Praxisleitfäden. Ein erster wird gerade erarbeitet – und mit dem Prozess sind viele unzufrieden.

Diese Verwendung des Begriffs #Aktivisten tut schon etwas weh (denn meist kämpfen diese für zumindest vermeintlich dem Gemeinwohl dienende Ziele), auch wenn sie wohl nicht falsch ist.

Vielleicht liegt die Veränderung eher im Übergang von Wahlbeeinflussung versteckt hinter den Kulissen zu offen und mit Mitteln des Marktes auf der Bühne und im Publikum??

L'Austriaco proposto come Commissario per gli Affari Interni e l'Immigrazione, comparirà in un'audizione organizzata dal Comitato per le Libertà Civili il 5 novembre. Ecco cosa ha detto durante l'audizione del 10 ottobre:

Accesso ai dati per scopi di applicazione della legge
DOMANDA: Come intende affrontare la sfida fondamentale di garantire un accesso efficace ai dati personali al fine di prevenire, rilevare, investigare e perseguire reati penali, rispettando al contempo i principi di necessità e proporzionalità e sostenendo i diritti alla privacy e alla protezione dei dati?
Quali garanzie prevede per garantire la piena conformità alle sentenze della Corte di giustizia europea sulla conservazione dei dati e l'accesso ai dati per scopi di applicazione della legge?
Affronterà anche la crittografia quando propone norme sull'accesso?
Come intende sbloccare la proposta sugli abusi sessuali sui minori online per garantire che il suo obiettivo principale di proteggere i bambini sia soddisfatto e che le preoccupazioni sulla salvaguardia del diritto alla privacy siano affrontate? Qualora non ci fosse un regolamento su questo fascicolo prima della scadenza della seconda proroga del regolamento provvisorio, prevista per il 3 aprile 2026, come intende procedere per evitare il vuoto legislativo?
Risposta: Se confermato, mi impegno a trovare un approccio equilibrato e giuridicamente valido per garantire un accesso efficace ai dati per le forze dell'ordine e la magistratura, rispettando al contempo la privacy e la protezione dei dati, nonché i requisiti di sicurezza informatica e tenendo conto degli aspetti tecnologici. L'UE deve costruire una solida economia digitale che i cittadini possano vedere come porterà prosperità, preserverà la sicurezza e proteggerà i diritti fondamentali. Allo stesso tempo, mentre la società e l'economia diventano digitali, lo fanno anche i criminali, i terroristi e gli altri attori della minaccia, al fine di perseguire attività criminali ed eludere le forze dell'ordine. Al fine di garantire che le autorità competenti siano dotate di capacità moderne e innovative per combattere la criminalità, consentire alle forze dell'ordine di avere un accesso proporzionato ai dati è fondamentale per collegare i crimini agli autori, supportare le indagini, proteggere le vittime e smantellare le reti criminali. Tuttavia, oggi, le barriere legali e tecniche, insieme alla mancanza di leggi armonizzate sulla conservazione dei dati negli Stati membri, ostacolano le indagini nazionali e complicano la cooperazione transfrontaliera. Nonostante queste sfide, sono convinto che possiamo trovare soluzioni efficienti e a prova di futuro per facilitare l'accesso legale alle informazioni digitali. Ciò è essenziale per proteggere i nostri cittadini e sostenere lo stato di diritto, nel pieno rispetto dei principi di necessità e proporzionalità.

Allo stesso tempo, dobbiamo evitare di introdurre nuove vulnerabilità che possono essere sfruttate da attori malintenzionati o di mettere in discussione i vantaggi della crittografia. Dobbiamo trovare un equilibrio che ci consenta di salvaguardare la privacy, garantendo al contempo sicurezza e protezione dei nostri cittadini e delle nostre società dalle minacce in continua evoluzione.
Il gruppo di alto livello sull'accesso ai dati per le forze dell'ordine ha definito le esigenze operative delle forze dell'ordine e delle autorità giudiziarie e le raccomandazioni includono una serie di misure diverse, come il rafforzamento delle capacità, la cooperazione con l'industria, la standardizzazione e la legislazione. Dovrebbero costituire un prezioso contributo per il lavoro in quest'area, che richiede una valutazione d'impatto approfondita.

La criminalità e l'insicurezza hanno un effetto soffocante sulla società e, se non affrontate correttamente, impediscono alle persone di esercitare le proprie libertà, di esprimere la propria opinione o di camminare per strada comodamente. Le minacce possono anche essere più dirette non solo offline, ma anche online. I bambini sono particolarmente a rischio e dobbiamo fare di più per proteggerli da molteplici rischi che vanno dal cyberbullismo alla sextortion, dalle dipendenze online alla radicalizzazione. Sono convinto della necessità e dell'urgenza di adottare il regolamento proposto per prevenire e combattere l'abuso sessuale sui minori online. Nel 2010, sono state segnalate circa 1 milione di segnalazioni di materiale di abuso sessuale sui minori e di adescamento online. Entro il 2023, sono state segnalate più di 36 milioni. L'attuale regolamento "provvisorio", che consente il rilevamento volontario di abusi sessuali su minori da parte dei fornitori di determinate piattaforme online, scadrà nell'aprile 2026. Senza le norme a lungo termine proposte, tale forma di rilevamento che ha contribuito a salvare i bambini e a identificare i trasgressori per oltre 10 anni sarà vietata nell'UE. Credo che possiamo e dovremmo trovare un modo fattibile per finalizzare i negoziati sul regolamento in sospeso affinché entri in vigore in tempo prima della scadenza del regolamento provvisorio.

Se confermato, mi impegno a lavorare anche per finalizzare i negoziati sulla revisione della direttiva sulla lotta all'abuso sessuale sui minori. La direttiva integra il regolamento e fornisce uno standard comune per le indagini e le azioni penali, armonizzando le definizioni di reati e sanzioni. È una parte essenziale dell'equilibrio che la nostra società esige dal mondo digitale.

Ein Monopolist für Gefängniskommunikation hatte eine Sicherheitslücke in seinem System. Über eineinhalb Jahre standen Daten von Telefonaten offen im Netz, die Insass:innen mit der Außenwelt gehalten haben. Wie oft die Daten abgerufen wurden, ist laut Hersteller nicht nachvollziehbar.

@quincy we kind of have, but if a majority still votes for candidates and parties, that can be trusted to make it wrong, than we will get it wrong. Most people should have the capacity to know and see for what they vote. Maybe I'm too optimistic with what brainpower each person has, but I'm convinced that it's enough. Maybe people should see and experience how serious politics is? Still a thing that shouldn't be needed after Nazis. I don't know.

Wir alle nutzen Online-Plattformen, von der Google-Suche über WhatsApp zu Microsoft Office. Höchste Zeit, dass Nutzende auch mitbestimmen, wie sie funktionieren. In der Realität sind wir davon weit entfernt. Dabei gäbe es eine Lösung: Plattformräte.

Eine neue EU-Richtlinie soll die Arbeitsbedingungen von Plattformarbeitenden verbessern. Die Mitgliedstaaten haben in der Umsetzung allerdings große Freiräume. Gewerkschaften, Forschende und Plattformarbeitende fordern deshalb eine klare und starke Umsetzung in deutsche Gesetze.

Mitte Januar geht die elektronische Patientenakte für alle an den Start. Forschende bescheinigen dem Konzept allerdings gravierende Schwachstellen. Um ein möglichst hohes Maß an IT-Sicherheit und Datenschutz zu gewährleisten, will die gematik nachbessern.
