The European Parliament’s LIBE Committee has backed a new Europol Regulation granting the agency unprecedented powers to collect, process & share personal data — including biometrics & facial recognition — with non-EU states.

👁️‍🗨️ If approved in plenary later this month, it will hand Europol vast surveillance powers, further entrenching the EU’s criminalisation of migration & solidarity.

Die freie und kostenlose Verfügbarkeit von #Urteilen ist tatsächlich ein wichtiger Aspekt der #Transparenz staatlichen Handelns, hier der #Justiz. Dass bislang eher wenig #Entscheidungen veröffentlicht werden, hat aber nichts mit Heimlichtuerei oder #Geheimjustiz zu tun. Vielmehr gibt es dafür v.a. zwei Gründe, die aber aktuell an Relevanz verlieren:

1. Bislang war die #Anonymisierung #personenbezogener Daten in Urteilen sehr aufwändig, weil von Hand vorzunehmen. In Kürze werden KI-Tools hierfür marktreif sein. Dann reduziert sich der händische Aufwand darauf, zu kontrollieren, ob auch alle relevanten Daten anonymisiert wurden.

2. Bislang haben #Richter*innen Urteile v.a. dann veröffentlicht, wenn darin "juritische Neuigkeiten" enthalten waren, also eine Änderung der #Rechtsprechung, erstmalige Auslegung neuer Normen u.ä. In Zeiten von KI werden Urteile aber auch als #Trainingsdaten interessant und für eine quantitative Auswertung. Von daher entwickelt die Justiz auch selbst ein größeres und in der Zielrichtung neues Interesse an steigenden Veröffentlichungsquoten.

Super wäre es, wenn damit auch ein Wandel in der Urteilssprache einhergehen könnte. Denn wenn Urteile auch für Nicht-Jurist*innen verständlich werden, ist das noch einmal ein wichtiger Beitrag zur Transparenz.

The proposal expands Europol’s #surveillance capacities, allowing it to collect and use biometrics like #FacialRecognition on a massive scale, without transparency and effective safeguards against abuse.

2️⃣ Unsafe:

This reform encourages data collection & data sharing from and with third countries, including authoritarian regimes.

It turns “anti-smuggling” into a blank cheque for surveillance against migrants, NGOs & journalists.

❌ No impact assessment.
❌ No proof it works.
Even the European Data Protection Supervisor @EDPS warns it violates EU law and puts #privacy & safety at risk.

This reform won’t protect people. It’ll criminalise solidarity, erode democracy, and put everyone under surveillance.

Una nuova vittoria di NOYB: L'Autorità Garante per la Protezione dei Dati Personali (DSB) ha emesso una decisione in cui ha stabilito che Microsoft 365 Education traccia illegalmente gli studenti e utilizza i dati degli stessi per scopi propri di Microsoft.

Il colosso del software non ha inoltre risposto a una richiesta di accesso relativa a Microsoft 365 Education, ampiamente utilizzato nelle scuole europee. Microsoft ha invece cercato di trasferire tutta la responsabilità alle scuole locali. Sebbene le scuole interessate debbano fornire dati di accesso più dettagliati e ulteriori informazioni sulla privacy, secondo la decisione, spetta ora a Microsoft chiarire definitivamente in che modo utilizza i dati degli utenti per i propri scopi aziendali.

Much of today’s internet exploits attention & vulnerability instead of supporting free, informed choice.

The Digital Fairness Act (DFA) can change that, by banning manipulative design & making fairness-by-design the norm.

EDRi has submitted its response to the European Commission's call for evidence, urging:
🔴 Bans on manipulative design
🔴 Fair defaults & real consent
🔴 Behavioural design impact checks
🔴 Strong, coordinated enforcement

There's one other thing I'd add: minimum penalties. The GDPR has teeth in terms of maximum penalties, but now everyone expects that the fines will be much smaller than the maximum. Companies involved in these practices can afford large fines as the cost if doing business. The fines need to start large and get larger if the problems are not remedied.

The @EUCommission called out TikTok & Meta for breaking key transparency & accountability rules under the #DSA

The two tech giants made unnecessarily difficult to access data and, in Meta’s case, used deceptive interface design that confuses & discourages users from flagging illegal content.

After this preliminary decision, we urge the Commission to move swiftly toward final remedies & fines — because justice delayed is justice denied.

Could you please improve the audio processing? The file volume is too quiet, so I have to crank the phone volume up and risk damaging my hearing in case of notifications or the next podcast. The stereo effect between the persons feels weird and too strong on headphones, which is distracting.
Also, at least johas' voice sounds too robotic.

Sigfrido Ranucci denuncia: «C’è chi vuole armare il Garante della privacy per punire Report». La replica: «Noi indipendenti e trasparenti»

Il giornalista Sigfrido #Ranucci, conduttore di Report, ha denunciato pubblicamente un presunto tentativo di «punire» la sua trasmissione attraverso l’uso politico del Garante per la privacy. «In questi giorni sto ricevendo solidarietà bipartisan, ma si sta rivelando ipocrita — ha detto — perché da una parte mi si esprime vicinanza, dall’altra qualcuno sta armando il Garante per colpire Report e dare un segnale esemplare ad altre trasmissioni». Ranucci ha parlato da remoto nel corso di una conferenza stampa al Parlamento europeo, organizzata dall’eurodeputato del Partito democratico Sandro Ruotolo.

Nota del canale: deregittimare le autorità indipendenti non è mai una buona idea. La politica non attende altro. Se Ranucci dispone di informazioni sul fatto che il #GarantePrivacy si sia prestato un uso politico del suo ruolo, dovrebbe immediatamente informare le autorità giudiziaria. L'autorità per la protezione dei dati personali si muove nell'ambito delle proprie prerogative, talvolta d'ufficio. E quindi sempre possibile che un reclamo al garante venga fatto sulla base di motivazioni politiche, ma viene sempre vagliato in base alla procedibilità.
