Una critica femminista al regolamento CHATCONTROL. La politica digitale femminista si interroga criticamente se l’uso delle tecnologie paternalistiche.
«...la non negoziabilità dei diritti fondamentali fa parte di una prospettiva di politica digitale femminista. Il diritto alla privacy e il diritto alla protezione contro la violenza non dovrebbero essere contrapposti. Sono tutti essenziali per la partecipazione sociale e democratica di tutti, in particolare dei gruppi sottorappresentati e, non ultimi, dei bambini e degli adolescenti.
Le proposte politiche devono essere sottoposte a una valutazione dell’impatto contestuale e sociale in modo che l’uso delle tecnologie prescritto dalla legge non oscuri i problemi esistenti o addirittura crei nuove sfide. Il passato dimostra che tali valutazioni d’impatto di solito coprono solo il livello giuridico o tecnico. Tuttavia, per creare soluzioni davvero sostenibili ed eticamente responsabili, è necessario includere anche fattori civili ed economici. Anche la realizzazione tecnica deve essere accompagnata criticamente e analizzata iterativamente. Perché non è chiaro quali soluzioni si stiano sviluppando riguardo alle normative aperte alla tecnologia. È quindi ancora più importante che il legislatore sia responsabile della creazione di una base che stabilisca una linea rossa chiara per le tecnologie altamente problematiche dal punto di vista etico e giuridico.
Il regolamento CSA mostra la complessità del rapporto tra problemi sociali e potenziali soluzioni digitali e quanto rapidamente il tecnosoluzionismo possa portare a conseguenze negative indesiderate. È responsabilità dei legislatori svelare tali complessità e sviluppare approcci risolutivi personalizzati e convenienti che riducano al minimo gli impatti negativi.»
